From: Tim on 14 Feb 2007 09:05 An Australian man Jason has been having an ongoing battle with Centrelink for years, he is so enraged at the bias of Centrelink, he set up a website centreflunk.com. He is being sued by Miner Ellison acting for Centrelink for Copyright breach. Paul Zawa from Minter Ellison is representing Centrelink against the aggrevieved Centrelink client Jason. A $5,000 payment to Minter Ellison from Australian taxpayers to screw an aggrevieved Centrelink client! Who owns the Centrelink logo? The Australian government, can it be made into a parody by someone to whome the Centrelink logo is like the Nazi logo a symbol of oppression? Is anyone on this group prepared to help Jason pro bono as a Centrelink client being sued by Minter Ellison? http://centreflunk.com Notice the use of the logo that is what he is being sued by Paul Zawa a partner of: Minter Ellison Rialto Towers 525 Collins Street Melbourne Paul.Zawa(a)minterellison.com We act for Centrelink. Our client has previously communicated to you regarding the website located at http:www.centreflunk.com. Our client own the copyright of its logo. Some time Sparke Hellimore on behalf of our client, requested you remove this logo from the website and refraim using it in future. Despite this request you have continued to infringe our client's copyright reproducing the logo including the colours as well as variants of the logo on the website. As a result of your conduct our client requires that you: (a)immediately and permanently remove all depictions and variants of the logo from the website (b)undertake not to reproduce the logo(or variants) on the website or elsewhere in the future You may provide the above undertaking by signing, dating and returning a copy of this letter to: Mr Paul Zawa Partner Minter Ellison Rialto Towers 535 Collins Street MELBOURNE VIC 3000 Paul.Zawa(a)minterellison.com

The ambiguities are also interesting: 1. How variant does a 'variant' have to be to avoid people confusing it with the original? Yet the 'variant' must be similar enough for the website to fulfil its purpose. 2. Minter-Ellison represents Centrelink which is owned by Australians. Centreflunk represents the interest of Australians. The people versus the people? 3. Publicity: Centreflunk, Jason and anyone who helps Jason in this case can be assured of plenty of free publicity. Centrelink otoh is going to get a lot of unwanted publicity. > > As a result of your conduct our client requires that you: > > (a)immediately and permanently remove all depictions and variants of > the logo from the website > > (b)undertake not to reproduce the logo(or variants) on the website or > elsewhere in the future > ....

It seems a waste of tax payers' money for the Government to be pursuing Jason over this. Still, copyright is copyright. Jason's site would not be seriously affected if he were to remove the logos. Sylvia.
