From: petrolcan on 16 Apr 2010 04:25 Bought a lens on the 15th March which the seller described as having slight dust inside. The price I paid took this into account. Received the lens nearly a week later and no dust whatsoever. In place of the dust however was three seperate areas of fungal growth on three of the internal elements. Sent off an email to the seller who just suggested that I sell it on and that I got it for a good price. Obviously this annoyed me as having looked at his other listings it was quite obvious that he knew exactly what fungal growth looked like. So, I file a dispute on the 23rd. Seller responds the following day offering me refund of purchase price but not postage upon return of lens. I respond the same day saying I want complete refund otherwise I'm out of pocket to the tune of about £10. Seller then takes five days (29th) to respond to me saying that the refund is a gesture of goodwill so I respond, again the same day, saying that I will only accept a full refund. And then nothing. So on the 11th April I escalate to ebay customer support(1) who the following day find in my favour and tell me to send back the lens. I sent the lens back on the 12th (recorded of course) and an attempt was made to deliver on the 13th. So far the seller hasn't picked it up. So, my question is this, if the seller doesn't pick up or arrange redelivery and the lens comes back to me, where do I stand on the refund front?

Send email telling him that each time you have to repost the item you will be adding that extra cost to any monies he will have to refund. Tell him this will be reclaimed through the court sytem if necessary. MC

Even if one files a SNAD return postage isn't refunded.

But the courts will probably see it differently. I know because I've done it. MC |
