From: Marcus Redd on 4 Dec 2006 04:40 Further to my threads below (see "VAT added" and "What a lovely cop-out") I've finally received communications from the seller: 1st - He somehow didn't receive my email sent within a minute of bidding, wherein I apologised for not noticing his dodgy VAT clause and asked him to agree to cancel (this original email is still in my "Sent" folder at the eBay website.) 2nd - In response to my re-send of the above, "When you peruse a auction you need to read all the terms and conditions. You obviously did not read the auction in full. The bid will stand" 3rd - A payment reminder, but, curiously, nowhere in it is VAT mentioned - here, have a look: Dear nadamp, You are the winning buyer for the Nintendo DS Lite Game Console White. No, the VAT is not part of the Ebay auction so therefore the payment reminder email will not quote the VAT element seeing as the seller has specified in his auction that it is to be added to the final auction price. This is regardless of the legal aspect, please lets not argue the rights and wrongs again, the purpose of this post is to point out the incorrect assumption of the OP who by the looks of it is about to get a non payment strike. -- Niel H http://stores.ebay.co.uk/Snowdon-Computers http://www.ebayfaq.co.uk/ http://finance.groups.yahoo.com/group/UK_Powersellers/
From: bcc97 on 4 Dec 2006 05:09 I thought that the OP had cancelled under Distance Selling Regs, in which case there's no longer any contract and there's nothing to remind him of. However, the seller may need a 'reminder' about the Regulations!

Because he sent you mail without VAT added making item cheaper for you? 2. Just replied to your mail nicely (bit late). Looks good business reply to me. It sounds you never wanted the item in first place, bought it by mistake and then picked on his VAT practice to justify yourself. I suppose few sellers will be adding "nadamp" to blocked list??
